Taxing Online Education

It is not yet law, but the New York State Department of Taxation and Finance issued an opinion earlier this year distance education courses are subject to state sales tax.  Some states already impose a sales tax on educational software.  The New York opinion discounted the value of the faculty interaction aspect of the educational service provided by a certain distance education provider by the name of SkillSoft.  Even though students can only access the learning resources provided by SkillSoft online this opinion in New York states, “constitutes a transfer of possession of the software because the customer gains constructive possession of the software and gains the right to use, or control or direct the use of the software.”  So just by having access to educational software, even though such access is part of an educational service that includes mentoring/teaching by an educator, the State of New York believes students should pay sales tax for this distance learning experience.

Of course these are challenging economic times and state governments are looking for ways to find new sources of revenues, but adding sales tax to online education makes little sense. A tax consultant who is familiar with this case believes there was insufficient human interaction in this online course to justify the purchase of this course as being a non-taxable educational expense. One has to wonder exactly how much interaction between students and teacher is sufficient to deem online education an educational experience or the constructive possession of software.

When asked for a comment, Michael Lambert of the Distance Education and Learning Council (DETC) indicated his belief that this opinion of the New York State Department of Taxation and Finance will not survive legal challenge.  Still, this is a quite disturbing development. We need to be finding more cost/effective ways to deliver education, not looking for new ways to make it more expensive.

The Role of Plagiarism-Detection Software

In their efforts to deter plagiarism, many universities are using plagiarism-detection software.  To be more precise, however, the most popular software products like Turnitin and SafeAssignment compare students’ submissions to databases composed of journal articles, news reports, and student research papers to identify “matches.”  These matches indicate reasons for additional investigation by professors, but do not prove that acts of plagiarism have occurred.

A recent study at Texas Tech identified 400 papers submitted by students that were identified by plagiarism software as having “matches” with existing works.  Further investigation; however, revealed only two of the students’ papers were actually found to be plagiarized.

Globalization has made an enormous difference to the way we live and work, and I dont just mean the impact of petrol prices on our driving habits. Communicating with someone on the other side of the world is just as easy as communicating with someone next door. People change jobs more often than before, and jobs change just as frequently. And all these changes underscore the importance of education in this globalized, competitive, technology-driven, knowledge-based economy.

Of course, this is why so many people study on-campus at university or college. But many others already have jobs or other commitments and so cannot attend on-campus classes. If you are one of these people, online learning provides a flexible solution. But to succeed you need to take account of the following six guidelines.

When you study on-campus, other people organise much of your study time. With online learning, you have to organise it yourself. So be organised ” manage your time. Set aside a regular time in your diary for study of the material as if you were attending classes. And complete assignments well before the due dates. That way you have time to check them and also avoid those last minute things that go wrong when youre late. Do not be a poor time manager.

Living and working in todays ever-changing world demands life-long learning. And so if you wish to continue to be part of it, you must have a desire to learn and be motivated to learn for the rest of your life. So this means wanting to learn even when there is no extrinsic motivation (e.g., a salary increase).

Unfortunately, many of us were not taught how to learn. Instead we were only taught to remember things and to apply rules. Somewhere along the way we were expected to acquire the skills to acquire knowledge. In todays world it is essential that we know how to learn. In particular, learning online requires that you develop these skills. This not only means having the technical skills of how find books or web sites on a topic, it also means having well-developed critical reading and thinking skills.

For many of us, our school experience has taught us to be passive learners ” we were told the knowledge, we learned it by rote and then we repeated it in an exam. Passive learning seemed to be a useful strategy for success. Unfortunately, that is not a useful strategy for success in todays world, or, indeed, in online learning. If you are learning online, the courseware often includes questions, exercises and further reading so that your learning can be active rather than passive. You must make sure that you complete all the exercises and that you thoroughly interact with the material.

Lectures in high school classrooms and in undergraduate classes can all so easily encourage the passive learning already referred to. But real learning takes place when you are interacting with the materials and with others. So try to find a learning group, either in your area or online, and exchange ideas regularly. Also, make sure that you respond to all the e-Tutors requests for participation in the discussion forums. There may even be a mark allocated for such participation.

Dont be tempted to buy a qualification from a diploma mill – a business that simply prints diplomas and degrees. Such qualifications are worthless in the eyes of employers and genuine educational institutions, so will just be a waste of your money. Always take an accredited program from an accredited institution.

Online Cheating a Big Problem?


One of the clouds appearing on the horizon for online universities is The College Opportunity and Affordability Act signed by President Bush late in 2008. This new law requires universities to authenticate test takers taking online courses through costly identification technology or with exam proctors.


The federal Education Department is expected to release guidelines for implementing this new law in the months ahead so the new law can be made effective later this year or early 2010. They say the “devil is in the details,” but on the surface this provision of the new law seems to provide uncertain benefits combined with certain increases in costs for online universities – and ultimately their students.

Why Online Students Stop Studying


November 2008, Education Dynamics conducted a survey of 150 online students who discontinued their effort to earn an online degree or certificate program. Perhaps the most surprising result was the finding that almost half of the online students surveyed failed to complete their first course.
